Kathy Hayter, led by Brendan Roche QC, has appeared before Mr Justice MacDonald in the High Court in MBC v AM & Ors (DOL Orders for Children Under 16) [2021] EWHC 2472 (Fam), representing a child through their Guardian.
Within the landmark case, Mr Justice Macdonald conjoined 4 Cases for determination of the novel legal issue of whether the High Court Family Division is able to grant an authorisation of deprivation of liberty in the case of a child under 16 years for the purpose of Article 5(1) in an unregistered placement.
